Bill Veto!
The American Institute of Architects New York State (AIANYS) wrote to Governor Cuomo to declare their strong opposition to bill (S.6686/A.7945-A) and requested his disapproval of this legislation.
This bill would have allowed contractors, sub-contractors, and materialmen to make a claim for any delay, disruption, interference, inefficiencies, impedance, hindrance or acceleration in the performance of a contract for public work. Additionally, this bill would not only have allowed these entities to pursue a public owner for damages, they would also have been allowed to assert a claim against the owner’s representatives and consultants—for whom the contractor has no contractual privity.
The Bill was disapproved.
